OVERVIEW
This website is operated by Fincent Enterprises LLC, doing business as West End Rd (“West End Rd,” “we,” “us,” or “our”). West End Rd offers this website, including the information, content, features, tools, products, and services available through westendrd.com (collectively, the “Services”), subject to these Terms of Service (“Terms”).
Our online store is hosted by Shopify, which provides the ecommerce platform that enables us to offer products and Services to you.
By visiting the website, creating an account, placing an order, or otherwise using the Services, you agree to these Terms and to the policies referenced here, including our Privacy Policy, Shipping Policy, and Return and Refund Policy. If you do not agree, do not use the Services.
These Terms contain important information about your rights and obligations, as well as limitations and exclusions that may apply to you. Nothing in these Terms limits any right or remedy that cannot lawfully be limited under applicable consumer-protection law.
1. ELIGIBILITY AND ACCOUNTS
You must be at least the age of majority in your jurisdiction, or have the permission and supervision of a parent or legal guardian, to use the Services or place an order. You may not use the Services if applicable law prohibits you from doing so.
You may be able to create an account to make shopping and order management more convenient. You agree to provide current, complete, and accurate information and to update it when necessary.
You are responsible for safeguarding your account credentials and for activity conducted through your account. Notify us promptly at care@westendrd.com if you suspect that your account or password has been lost, stolen, or used without authorization. We may suspend or restrict an account when reasonably necessary to protect you, us, or the Services.
2. PRODUCTS AND AVAILABILITY
We make reasonable efforts to describe and display our products accurately. However, colors and details may appear differently depending on photography, lighting, production variations, and the settings of your device. Please review written product descriptions, materials, dimensions, and care information rather than relying only on photographs.
Products, sizes, colors, quantities, and availability may be limited and may change or be discontinued without notice. Placing an item in a shopping bag or cart does not reserve it. We may limit quantities purchased per customer, household, account, payment method, billing address, shipping address, or order.
Unless we agree otherwise in writing, products are offered for personal use and not for unauthorized resale or commercial distribution. We may refuse or cancel orders that reasonably appear to involve fraud, abuse, automated purchasing, or unauthorized resale.
3. ORDERS AND ACCEPTANCE
Submitting an order is an offer to purchase the selected products. An automated order-confirmation message acknowledges that we received the order; it does not necessarily mean that we have accepted it. We accept an order when we confirm fulfillment or shipment, unless applicable law provides otherwise.
We may verify information before accepting or fulfilling an order. We may refuse or cancel all or part of an order for reasons including product unavailability, pricing or description errors, payment problems, suspected fraud, shipping restrictions, quantity limits, resale activity, or a violation of these Terms.
If we cancel a paid order, we will refund the canceled amount to the original payment method. The timing for a credit to appear may depend on your payment provider.
4. PRICES, TAXES, AND PAYMENT
Prices, discounts, and promotions may change without notice. The price charged will be the price displayed at checkout when your order is submitted, subject to correction of obvious errors. Unless checkout states otherwise, prices are displayed and charged in U.S. dollars.
Shipping charges, taxes, duties, and other applicable charges will be shown at checkout when required. If a product is displayed at an incorrect price because of a typographical, technical, or other error, we may reject or cancel the affected order and refund any amount already paid.
You represent that you are authorized to use the payment method submitted. You authorize us, Shopify, and our payment providers to charge the order total and to perform payment verification and fraud-prevention checks. A temporary authorization hold may appear before the final charge, depending on your payment provider.
5. PROMOTIONS AND DISCOUNT CODES
Promotions and discount codes may be subject to additional conditions and expiration dates. Unless expressly stated otherwise, promotions cannot be combined, applied to prior purchases, exchanged for cash, or used to purchase gift cards.
We may modify, suspend, or cancel a promotion affected by error, fraud, abuse, unauthorized distribution, or technical malfunction. If promotional terms conflict with these Terms, the promotional terms control for that promotion.
6. SHIPPING AND DELIVERY
Shipping destinations, processing times, available delivery methods, charges, estimates, tracking, address restrictions, and international-shipping information are described in our Shipping Policy:

Delivery dates are estimates unless we expressly agree otherwise. Carrier delays, severe weather, customs processing, service disruptions, and other circumstances outside our reasonable control may affect delivery.
Orders containing multiple products may be fulfilled in separate shipments. Ownership and risk of loss transfer as provided by applicable law. Nothing in these Terms limits mandatory rights concerning delayed, lost, damaged, or undelivered goods.
You are responsible for providing a complete and accurate delivery address. Contact care@westendrd.com promptly if a correction is required. We cannot guarantee that an address can be changed after an order enters processing or fulfillment.
7. RETURNS, EXCHANGES, AND REFUNDS

The Return and Refund Policy explains the return window, condition requirements, exclusions, return authorization, shipping costs, exchanges, inspection, and refund processing. That policy is incorporated into these Terms.
Items identified as nonreturnable or Final Sale before purchase are not eligible for voluntary return, except where applicable law requires otherwise. Nothing in our policy limits mandatory consumer rights relating to defective, damaged, misdescribed, or incorrect goods.
8. ERRORS AND CHANGES
Information on the Services may occasionally contain typographical errors, inaccuracies, or omissions concerning product descriptions, pricing, promotions, availability, shipping, or other matters. We may correct errors and update information at any time, including after an order is submitted. If a correction materially affects an accepted order, we will provide any notice or remedy required by applicable law.
We may update, suspend, or discontinue any part of the Services. We are not liable for a modification, suspension, or discontinuation except where applicable law provides otherwise.
9. INTELLECTUAL PROPERTY
The Services and their content—including text, graphics, photographs, videos, product names, logos, icons, layout, design, and software—are owned by or licensed to West End Rd and are protected by applicable intellectual-property laws.
We grant you a limited, revocable, nonexclusive, nontransferable right to access and use the Services for personal, noncommercial shopping and informational purposes. This permission does not transfer any ownership rights.
Without our prior written permission, you may not reproduce, distribute, publish, sell, license, modify, create derivative works from, commercially exploit, scrape, systematically extract, or use automated means to copy the Services or their content, except where applicable law expressly permits such activity. You may not use our name, trademarks, logos, metadata, or trade dress in a manner likely to cause confusion or imply endorsement.
10. USER CONTENT AND REVIEWS
The Services may allow you to submit reviews, photographs, comments, feedback, suggestions, or other materials (“User Content”). You retain ownership of User Content you create.
By submitting User Content, you grant West End Rd a nonexclusive, worldwide, royalty-free, sublicensable license to use, reproduce, adapt, publish, translate, distribute, and display that content in connection with operating, improving, promoting, and marketing our business and Services, subject to applicable law and our Privacy Policy.
You represent that you have the right to submit the User Content and that it is accurate and does not violate law or another person’s privacy, publicity, copyright, trademark, or other rights. User Content must not be fraudulent, defamatory, threatening, harassing, obscene, hateful, discriminatory, malicious, or harmful, and must not contain malware, unauthorized advertising, or confidential personal information.
We may, but are not obligated to, monitor, edit, decline, or remove User Content. User Content reflects the views of its author and not necessarily those of West End Rd.
11. PROHIBITED USES
You may not use the Services to:
• Violate applicable law or another person’s rights.
• Commit or facilitate fraud, deception, abuse, harassment, or unlawful activity.
• Submit false, misleading, infringing, harmful, or malicious content.
• Transmit viruses, malware, or other code intended to interfere with any system.
• Obtain or attempt to obtain unauthorized access to an account, system, network, or data.
• Interfere with the security, availability, or proper operation of the Services.
• Collect or track personal information about others without lawful authorization.
• Use bots, scripts, scraping tools, automated purchasing systems, or similar technology to access, copy, overload, or exploit the Services without our written permission.
• Circumvent purchase limits, access restrictions, security measures, or technical protections.
We may suspend or terminate access when we reasonably believe these restrictions have been violated.
12. THIRD-PARTY SERVICES AND LINKS
The Services may contain third-party tools, integrations, content, or links, including services provided by Shopify, payment providers, carriers, social networks, and applications. Third-party services are governed by their own terms and privacy policies.
We do not control and are not responsible for third-party services, content, security, availability, or conduct. Your use of third-party services is at your own risk, subject to rights that cannot lawfully be excluded.

14. COPYRIGHT AND RIGHTS COMPLAINTS
We respect intellectual-property rights. If you believe material on the Services infringes your copyright or another legal right, email care@westendrd.com with:
• Your name and contact information.
• A description of the protected work or right.
• The location of the material you believe is infringing.
• A statement explaining your good-faith belief that the disputed use is unauthorized.
• A statement that the information in your notice is accurate and that you are the rights owner or authorized to act for the owner.
• Your physical or electronic signature.
We may request additional information reasonably necessary to evaluate the notice.
15. DISCLAIMER OF WARRANTIES
To the fullest extent permitted by law, the Services are provided on an “as available” basis. We do not guarantee that access will always be uninterrupted, timely, secure, or error-free, or that all defects will be corrected.
We do not exclude or limit warranties, guarantees, representations, or consumer rights that cannot lawfully be excluded. Product-specific warranties, if any, will be disclosed separately.
16. LIMITATION OF LIABILITY
To the fullest extent permitted by law, Fincent Enterprises LLC, West End Rd, and their owners, officers, employees, affiliates, agents, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or relating to the use of, or inability to use, the Services.
Where liability cannot be excluded, it is limited only to the extent permitted by applicable law. Nothing in these Terms excludes or limits liability that cannot legally be excluded, including liability for fraud, intentional misconduct, death or personal injury caused by negligence, or violation of mandatory consumer rights.
17. INDEMNIFICATION
To the extent permitted by law, you agree to indemnify and hold harmless Fincent Enterprises LLC, West End Rd, and their owners, officers, employees, affiliates, agents, licensors, and service providers from third-party claims, losses, liabilities, damages, and reasonable expenses arising from your unlawful misuse of the Services, your breach of these Terms, your User Content, or your violation of another person’s rights.
18. TERMINATION
You may stop using the Services at any time. We may suspend or terminate your access if we reasonably believe you have violated these Terms, used the Services unlawfully or fraudulently, or created risk or harm for us, our customers, or another person.
Provisions that by their nature should survive termination—including provisions concerning ownership, User Content licenses, disclaimers, limitations of liability, indemnification, and disputes—will remain effective.
19. GOVERNING LAW AND DISPUTES
Before filing a formal claim, you and West End Rd agree to make a good-faith effort to resolve the dispute informally. Send a written description of the issue and requested resolution to care@westendrd.com. We will use reasonable efforts to respond.
These Terms and disputes relating to them are governed by the laws applicable to Fincent Enterprises LLC in the jurisdiction where it is organized, without regard to conflict-of-law principles, except where mandatory law provides otherwise. A dispute may be brought in a court with lawful jurisdiction.
Nothing in these Terms requires either party to resolve a dispute through mandatory arbitration, and these Terms do not waive any right to participate in a class or collective action.
20. CHANGES TO THESE TERMS
We may update these Terms by posting a revised version and changing the “Last updated” date. Changes apply prospectively from publication unless applicable law requires otherwise. An order is governed by the version presented when the order was placed.
21. SEVERABILITY; WAIVER; ASSIGNMENT
If any provision of these Terms is found unlawful or unenforceable, that provision will be enforced to the greatest extent permitted and the remaining provisions will remain effective.
Our failure to enforce a provision is not a waiver of the right to enforce it later. You may not assign your rights or obligations under these Terms without our written consent. We may assign our rights and obligations in connection with a merger, reorganization, sale of assets, or other business transaction, subject to applicable law.
22. ENTIRE AGREEMENT
These Terms and the policies referenced in them constitute the entire agreement between you and us concerning the Services and replace prior or contemporaneous communications concerning the same subject. Additional terms may apply to a particular product, promotion, feature, or service; if those additional terms conflict with these Terms, the additional terms control for that product, promotion, feature, or service.
23. ELECTRONIC COMMUNICATIONS
When you use the Services or communicate with us electronically, you consent to receive service-related communications electronically where permitted by law. Electronic communications satisfy legal requirements that communications be in writing to the extent permitted by applicable law.
Email is not always secure. Do not send passwords, full payment-card numbers, or other highly sensitive information by email.
